Terms of Service

1. The service
NurtureARC is a relationship CRM for coaches and non-clinical practitioners. It helps organize contacts, coaching engagements, scheduling, programs, payments, outreach, outcomes, alumni, referrals, and related practice operations.
2. Not clinical software
NurtureARC is not an electronic health record, medical device, emergency service, or substitute for professional legal, tax, medical, or mental-health advice. Do not use it to provide emergency services or store regulated clinical records unless a separate written agreement expressly permits that use.
3. Accounts and workspaces
You must provide accurate account information, protect your credentials, and use the service only for lawful professional activity. You are responsible for users you invite, the information you import, and the permissions you grant. Each practice workspace is logically isolated from other customer workspaces.
4. Client data and communications
You control the client and prospect information placed in your workspace. You must have a lawful basis to collect, import, process, and contact each person. You are responsible for consent, suppression lists, opt-outs, sender identity, and all communication content. NurtureARC must not be used to evade anti-spam, privacy, or consumer-protection laws.
5. Subscriptions and billing
Paid plans renew at the interval shown at checkout until cancelled. Prices, included features, and usage limits are displayed before purchase. You authorize the payment processor to charge the selected payment method. You may manage or cancel a subscription through Billing in Settings or the hosted customer portal. Cancellation stops future renewals and does not erase data immediately.
6. Optional integrations and AI
Third-party services are connected only when you authorize them. AI features are optional, may be plan-limited, and can produce inaccurate results. AI output is a proposal for human review, not an automatic instruction to contact a client or take a consequential action. You remain responsible for reviewing any generated content.
7. Availability, changes, and support
We work to keep NurtureARC reliable and secure, but uninterrupted availability is not guaranteed. Features may evolve to improve safety, performance, or usability. Material changes to these terms will be posted with a new effective date. Support requests can be submitted from Settings after signing in.
8. Suspension and termination
We may limit or suspend access to protect the service, users, or third parties; respond to unlawful use; address nonpayment; or investigate abuse. You may cancel your subscription and request export or deletion subject to legal, fraud-prevention, and backup-retention obligations.
9. Intellectual property
You retain rights to your data and content. NurtureARC and its software, design, documentation, and brand assets remain the property of their respective owners. You receive a limited, non-transferable right to use the service while your account is active and compliant.
10. Disclaimers and liability
To the fullest extent allowed by law, the service is provided without warranties that cannot legally be excluded. Neither party is liable for indirect or consequential losses. NurtureARC's aggregate liability for claims relating to the service will not exceed the fees you paid for the service during the 12 months before the event giving rise to the claim, except where applicable law requires otherwise.
11. General terms
If any provision is unenforceable, the remaining terms stay effective. These terms are governed by the laws applicable to the operator's principal place of business, without regard to conflict-of-law rules, unless consumer law requires a different result.
